License to Publish

In order to publish your article, we need your agreement. Please take a moment to read the terms of this License to Publish agreement (“License”).

By submitting your article for publications, you and all co-authors of your submission agree to the terms of this License: You grant Reliabilityweb.com, (the “Publisher”) on behalf of itself, its affiliates, licensees and assigns, the exclusive right to reproduce, modify and/or distribute your article and portions thereof (including but not limited to the abstract and the graphics), as well as all intellectual property included therein, throughout the world in any format and in any medium, including but not limited to electronic, printed, video and audio, and to authorize others to do the same, including but not limited to reproduction rights organizations such as the Copyright Licensing Agency and the Copyright Clearance Center, and other document distributors. You agree that we may publish your article, and that we may sell or distribute it, or portions of it, on its own, or with other related material. Although Reliabilityweb.com may modify and translate the article, Reliabilityweb agrees to maintain the publishing intent of the original article. Publisher agrees that all publications of the article and portions thereof shall give attribution to you and the authors in the form of a byline. By submitting your article for publication, you warrant that you have the full right to grant the rights under this License and that the article is your original work, has not previously been published, and is not currently under consideration by another publication. You also warrant that the article does not contain anything that is libelous, illegal or infringes any third party's copyright, patent or other rights. If the article contains material that is a copyrighted or patented work of a third party, you warrant that you have obtained the unrestricted permission of the intellectual property owner to use the material and that the material is clearly identified and acknowledged in the text and in the graphics. The copyright to the article remains yours.

You also retain the right to use the article (provided you acknowledge the published original in standard bibliographic citation form) in the following ways, as long as you do not sell it in ways that would conflict directly with our efforts to disseminate it:

1. You are free to use your article for internal, educational, or other purposes of your own institution or company.

2. You may use the article, in whole or in part, as the basis for your own further publications or spoken presentations.

3. You may mount the final version of your article as published by Publisher, including on Reliabilityweb.com on your own, your institution's, company’s or funding agency’s website. For this last option, you can order the final published version of your article in PDF and print versions. Please contact publishing@reliabilityweb.com for more details.

You will indemnify, defend and hold the Publisher, its directors, officers, employees, agents, customers, users, successors and assigns harmless from and against all claims, demands, suits, causes of action, awards, judgments and liabilities, including reasonable attorneys’ fees and costs, arising out of or alleged to have arisen out of breach of your representations, warranties, or other obligations under this License. Notwithstanding any other clause in this License, in no event will the Publisher be liable for any special, indirect, incidental, punitive or consequential damages whether in an action based on contract, tort or any other legal theory, whether or not the Publisher has been notified of the possibility thereof, and in no event will the Publisher's total aggregate liability for any damages arising from or in connection with this License exceed fifty dollars (US$50.00). The foregoing limitations, exclusions and disclaimers are an allocation of the risk between the parties and will apply to the maximum extent permitted by applicable law, even if any remedy fails in its essential purpose.

This License constitutes the entire agreement between the parties concerning the subject matter hereof, and this License supersedes all prior or contemporaneous discussions, proposals and agreements between the parties relating to its subject matter. No amendment, modification or waiver of any provision of this License will be effective unless in writing and signed by both parties. If any provision of this License is held to be invalid or unenforceable, the remaining portions will remain in full force and effect and such provision will be enforced to the maximum extent possible so as to effect the intent of the parties and will be reformed to the extent necessary to make such provision valid and enforceable.

This License will be governed by the laws of Nebraska without regard for its choice of law provisions. All disputes arising out of or relating to this License will be submitted to the exclusive jurisdiction of the state or federal courts of Nebraska. The relationship of the parties is that of independent contractors. All notices will be in writing and sent by postage prepaid, via registered or certified mail or overnight courier, return receipt requested, or delivered personally to the parties at their respective addresses. Notice will be considered given upon receipt. You may not assign this License or any of its rights or obligations hereunder without the prior written consent of the Publisher.
